1Objective
1.1This document and the Annex hereto (collectively the "Procedure"), effective January 1, 2017, contains the procedures and conditions governing the use and protection of the ANSI Accreditation Mark or any reference to ANSI accreditation by an accredited conformity assessment body (CAB).
2Definitions
2.1As a general rule, definitions of ISO/IEC 17000 and ISO/IEC 17011 are applicable.
2.2ACCREDITATION CERTIFICATE: formal document or a set documents stating that accreditation has been granted for a defined scope
2.3ACCREDITATION MARK: legally registered trademark applied by or issued under the procedures of the accreditation system issued by an accreditation body to be used by accredited CABs to indicate their direct conformity with a set of accreditation requirements
2.4SCOPE OF ACCREDITATION: Specific conformity assessment services for which accreditation is sought or has been granted
3ANSI Accreditation Mark
3.1ANSI is the owner of all rights worldwide in and to the ANSI Accreditation Mark, and is the entity responsible for protection of that mark. No other entity has the right to apply to register, register, or claim rights in any mark containing or consisting of the ANSI Accreditation Mark or any confusingly similar marks.
3.2The ANSI Accreditation Mark is shown in Annex A attached as part of this procedure.
4Use of the ANSI Accreditation Mark and Reference to Accreditation - General
4.1The ANSI Accreditation Mark and reference to accreditation may only be used once accreditation has been granted.
4.2An accredited CAB shall take effective measures to ensure that the only ANSI accreditation mark it uses is the accreditation mark provided to it by ANSI.
4.3The ANSI Accreditation Mark shall be displayed only in the form, scaling, and color detailed by ANSI in Annex A to this Procedure. Accredited CABs shall base all reproductions of the ANSI Accreditation Mark on the master versions printed in Annex A to this Procedure. The master versions in Annex A are suitable for use as originals (i.e., they may be photographed for process reproduction or otherwise copied).
4.4Whenever the CAB presents the ANSI Accreditation Mark (e.g., on its website, in a print brochure, etc.), the CAB shall print its accreditation number (found on the Accreditation Certificate) centered immediately under the ANSI Accreditation Mark. The accreditation number shall appear in the four-digit format provided by ANSI.
4.5The CAB shall indicate under the ANSI Accreditation Mark the accreditation program and applicable accreditation standard under which accreditation has been granted. This information is to be centered under the accreditation mark. The required language for each accreditation program follows, and must appear in English; translations are not permitted:
ISO/IEC 17065 Product Certification Body
ISO/IEC 17024 Personnel Certification Program
ISO 14065 Greenhouse Gas Validation Body
ISO 14065 Greenhouse Gas Verification Body
ISO 14065 Greenhouse Gas Validation and Verification Body
ASTM E2659 Certificate Issuer
4.6The specifications for the requirements set forth in sections 4.4 and 4.5 are in Annex A to this Procedure. Annex A also contains examples of their use.
4.7The use of the ANSI Accreditation Mark is contingent upon the CAB identifying the specific scope(s) for which it is accredited. The scope of accreditation must be clearly indicated when using the ANSI Accreditation Mark or when making reference to accreditation.
4.7.1If there are multiple scopes of conformity assessment within a CAB and one or more are not accredited by ANSI, this must be clearly delineated and the ANSI Accreditation Mark or reference to accreditation cannot be used with those unaccredited scopes of activity.
4.8The ANSI Accreditation Mark shall be used by an accredited CAB only under the name or the registered trade name of the legal entity which holds accreditation.
5Use of the ANSI Accreditation Mark and Reference to Accreditation - Specific
5.1The ANSI Accreditation Mark may be displayed on CAB stationery / letterhead subject to the following conditions:
5.1.1The symbol / logo or title of the accredited CAB is also shown and emphasized in a way that makes clear that it identifies the entity using the stationery / letterhead; and
5.1.2The ANSI Accreditation Mark is never given more significance than the symbol / logo of the accredited CAB.
5.2Accredited CABs may incorporate the ANSI Accreditation Mark in publicity materials that refer to accredited products or services, provided the conditions of this Procedure are met. Accredited CABs may make general reference to ANSI accreditation provided they ensure that ANSI accreditation is not stated or implied for non-accredited activities, sectors, or locations. The term "publicity materials" shall not include notices, labels, documents, or written announcements affixed to or otherwise appearing on goods or products.
5.3All quotations that contain the ANSI Accreditation Mark or refer to ANSI accreditation shall clearly define the scope(s) of accreditation.
5.4When a conformity assessment certificate issued by an accredited CAB incorporates the ANSI Accreditation Mark or refers to ANSI accreditation, or includes any of the appropriate disclaimers, the disclaimers shall be included on the front cover or first page or wherever the mark or reference to ANSI accreditation appears.
5.5When an accredited CAB wishes to make reference to its ANSI accreditation instead of using the ANSI Accreditation mark, it shall without variation use one of the following phrases after receiving written approval in accordance with the provision set forth below. The phrases must be in English; translations are not allowed.
An ANSI-Accredited Product Certification Body - Accreditation #xxxx
An ANSI-Accredited Personnel Certification Program - Accreditation #xxxx
An ANSI-Accredited Greenhouse Gas Validation Body - Accreditation #xxxx
An ANSI-Accredited Greenhouse Gas Verification Body - Accreditation #xxxx
An ANSI-Accredited Greenhouse Gas Validation and Verification Body - Accreditation #xxxx
An ANSI-Accredited Certificate Issuer - Accreditation #xxxxx
The accredited CAB shall take all reasonable steps to ensure that any client, when referring to the accredited CAB, uses this precise wording.
5.5.1To request approval to use one of the phrases in section 5.5, the CAB shall:
a)Submit a written request to ANSI staff detailing the proposed wording, and
b)Submit a pictorial representation of how the wording will appear in conjunction with the CAB's own symbol or logo.
5.5.2ANSI staff will respond in writing within 30 days, indicating whether the use of the wording as proposed by the CAB is acceptable. The phrase cannot be used until written approval is received from ANSI.
5.5.3The CAB shall bear responsibility for obtaining any required rights, for monitoring the use of the wording, and for ensuring that the wording is not misused.
6Use of Accreditation Certificates
6.1ANSI Accreditation Certificates issued to the accredited CABs can be used in advertisements or other materials used for business purposes.
6.2When the ANSI Accreditation Mark is used on certificates, it shall be used in accordance with the provisions of this Procedure.
7Withdrawal or Suspension of Accreditation
7.1Upon withdrawal or suspension of ANSI accreditation, the CAB shall immediately cease to issue conformity assessment certificates and any other materials displaying the ANSI Accreditation Mark or containing reference to ANSI accreditation.
7.2In the event that a CAB's accreditation is suspended or withdrawn, the CAB shall take all reasonable steps to ensure that it and its licensees immediately cease use of stationery, literature, websites, and advertisements bearing the ANSI Accreditation Mark or references to ANSI accreditation.
8Changes to ANSI Accreditation Mark
8.1Upon any modifications to the ANSI Accreditation Mark, ANSI will inform accredited CABs of the changes and proper use, and accredited CABs shall promptly conform to all modifications.
9Misuse of the ANSI Accreditation Mark or Reference to Accreditation
9.1The ANSI Accreditation Mark or reference to accreditation shall not be used in any way that might mislead the reader regarding the status of an accredited CAB. This includes, but is not limited to, instances where the ANSI Accreditation Mark or reference to accreditation
a)is claimed for scopes that are not accredited,
b)is included on statements that are not based on accredited activities, or
c)is used in conjunction with scopes of accreditation that have been suspended or withdrawn.
9.2The ANSI Accreditation Mark or references to accreditation shall not be used in any misleading manner. This includes, but is not limited to, the use of the mark in such a way as to imply that ANSI has certified or approved any product, person, or service certified by a CAB. ANSI accepts no responsibility for the quality or performance of the certified product, person, or service.
9.3The ANSI Accreditation Mark shall not be displayed on or in connection with any product or its labeling or packaging. For example, a Greenhouse Gas Validation and Verification Body that provides carbon footprint statements for a client's product is prohibited from displaying the ANSI Accreditation Mark on such statement.
9.4The ANSI Accreditation Mark shall not be used in literature relating to a certified product or service unless the mark appears directly adjacent to the accredited CAB symbol or logo, and the latter is emphasized in a way that makes it clear that it identifies the entity issuing the literature.
9.5The ANSI Accreditation Mark shall not be used in such a way as to imply that ANSI accepts any liability for the accuracy or correctness of the results reported or decisions taken by the CAB.
9.6The ANSI Accreditation Mark, or reference to ANSI accreditation, shall not be incorporated into a report or statement that does not contain any results from accredited work. Wherever the results of non-accredited scopes appear they shall be marked in an appropriate manner to ensure that they cannot be mistaken for accredited scopes.
9.7CAB clients shall not use the ANSI Accreditation Mark.
10Sanctions
10.1Any use of the ANSI Accreditation Mark or reference to accreditation that might contravene the conditions set out in this Procedure will be considered a misuse of the mark and subject to adverse action which may include a request for corrective action, withdrawal of ANSI accreditation, publication of the transgression, legal actions, or any other actions deemed necessary by ANSI to maintain the integrity of its mark.
