The Chinese government recently published three draft standards and regulations for public comment, which are considered to have wide coverage and profound impact on international trade and multinational business with operations in China. The American National Standards Institute (ANSI) encourages interested U.S. stakeholders to submit comments regarding these documents and their potential influence on U.S. companies by the respective deadlines.
Measures for Advancement of Enterprise Standardization
On November 24, China’s State Administration for Market Regulation (SAMR) called for public comment on its draft Measures for Advancement of Enterprise Standardization. The Measures are formulated following the Standardization Law of China in order to guide enterprises to improve products and service quality and promote high-quality development. It enumerates the requirements for enterprise standards formulation, self-declaration publicity and supervision system, the implementation of the enterprise standards “Forerunner” Program, policies on standard financing and credit building, talent education, and the incentives for developing enterprise standards that have indigenous innovation technologies, and produce significant economic and social benefits. The Measures also encourage Chinese enterprises to undertake or participate in the formulation of international standards.

Interested U.S. stakeholders can submit comments following the instructions on the SAMR website before the deadline of Thursday, December 23, 2021. ANSI also requests commenters share their feedback to ANSI at [email protected] in support of our determination of whether to submit ANSI comments.
Regulation for Administration of Data Security
On November 14, the Cyberspace Administration of China (CAC) released the draft Regulation for Administration of Data Security (in Chinese) on its website for public comment. Interested U.S. stakeholders can submit comments via email or mail to the designated recipients listed on the CAC website.
This regulation will function as guidance for the implementation of Cyber Security Law, Data Security Law, and Personal Data Protection Law, in order to regulate online data processing activities, ensure data security, protect the legitimate rights and interests of individuals and organizations in cyberspace, and safeguard national security and public interests. It specifies the requirements to protect and process personal information and critical/core data, cross-border data transfer, and the responsibilities of internet platform operators. It also explicates the punishments for violations, including fines, business suspension, license revoking, or criminal charges when criminally constituted.
The deadline for public comments is Monday, December 13, 2021.
Household and Similar Electrical Appliances General Requirements – Product Safety
On November 10, SAMR formally notified the World Trade Organization (WTO) with a draft of the national mandatory standard, Household and Similar Electrical Appliances General Requirements – Product Safety (in Chinese), in line with the WTO Agreement on Technical Barriers to Trade (TBT).
Focusing on the protection of human health or safety, this document specifies the terms, definitions, requirements and verification methods for general safety of household and similar electrical appliances. It is applicable to installation, use, maintenance, repair and other aspects of the life cycle of household and similar electrical appliances. This document is also applicable to the electrical parts of sporting goods and electric toys.
ANSI encourages interested U.S. stakeholders to submit comments to this notification through Notify US, a site managed by the National Institute of Standards and Technology (NIST) to assist the U.S. industry in voicing comments on proposed foreign technical regulations and conformity assessment procedures.
The deadline for public comments is Sunday, January 9, 2022.
